Presidential Immigration Announcement

On June 18, 2024 the US Department of Homeland Security (DHS) announced a new process to promote the unity and stability of families. The proposal includes a “parole in place” or PIP program for certain spouses of U.S. citizens who have been living in the US for at least 10 years.  As of today, we know that the government will begin accepting applications on August 19, however the details about the application process, forms, fees, or timeline have not been released. Be aware that USCIS will reject any filings for this process received before August 19.

Based on this new proposed program, you may be eligible to apply for your green card without leaving the United States, if, as of June 17, 2024:

  • You are in the United States after entering without permission; and
  • You have lived in the United States for at least 10 years and have never left; and
  • You are legally married to a U.S. citizen; and
  • You do not have certain criminal history and are not a threat to national security or public safety

USCIS will consider on a case-by-case basis whether to grant parole, and all requests will take into consideration immigration history, criminal history, and background checks. To apply, you will need to prove that you meet all the criteria so you can start gathering those documents, such as proof of presence in the US, right away. There may also be a required fee to apply, but we do not know yet what that cost will be.

Remember: There is currently NO WAY to apply for either program, so you should not pay anyone to file paperwork for you at this time. The wrong advice could harm your chances of staying in the United States, getting lawful status, or becoming a U.S. citizen. Also, this program could be legally challenged, so be aware that the implementation may be delayed or otherwise impacted.
